5 08/07/2010 After having heard learned counsel for the

petitioner as well as learned counsel for the State, this Court

is not convinced about the submission made at the Bar that

the pay scale given to the petitioner and the order passed by

the respondents contained in letter No. 1966 dated 24.7.2003

contained in Annexure-7 really falls foul of any law.

However, there is insistence on behalf of the

learned counsel for the petitioner that looking at the higher

qualification which the petitioner had at the time of

appointment in the department which he had served, he was

entitled to a pay scale higher than the Bill Clerks of other

department. Since there was no recommendation of a

replacement pay scale of the kind which would have

accommodated the petitioner’s interest there is some

provision made in this regard, according to him, in resolution

no. 660/F/2 issued by the Finance Department dated 8.2.1999

which is paragraph 21 of the said resolution.

Let the petitioner take his chance with the State

authorities a second time over if he is so convinced about the

applicability of paragraph 21 in his case. So far as the

present writ application is concerned, no order is required to

be passed on what has been stated by way of relief.

This writ application stands disposed of.
