3. 3.7.2008 Heard.

The four petitions arise out of one case i.e. Amadabad

P.S.Case no.75 of 2007 under Sections 397 and 396 IPC. Neither of the

six petitioners is named in the FIR and they have not been put on test

identification parade in spite of being in custody. Nothing has been

recovered from either of them. The learned A.P.P. concedes that there

could not be any material meaningful in the case diary except that their

names have appeared in the confessional statement of a co-accused.

Considering the material and the contentions, let the above

named six petitioners be released from custody on furnishing bond of

Rs.3,000/-(three thousand)each with two sureties of the like amount

each to the satisfaction of C.J.M.Katihar in the above noted case.
