Heard learned counsel for the appellant.

Learned counsel for the appellant has stated that appellant is in possession
over the disputed land till today.

The appeal is admitted on the substantial question of law nos. 1 and 8 as
framed in the memo of second appeal.

Issue notice.

Learned counsel to take steps with regard to deposit of requisite fee within a
week for summoning the lower court record. After deposit being made, office
is directed to summon the lower court record. List on the date fixed in the
notice.

In the meantime, operation of the impugned judgment dated 30.4.2010 shall
remain stayed.
