The matter is taken up in the revision of list.
The writ petition is of the year 2005.
By means of this writ petition, the petitioner has prayed for
quashing of the order dated 08.8.2005, passed by respondent
no. 2 by which she was placed under suspension.
This Court vide order dated 26.10.2005 has stayed the
operation of the impugned order of suspension with liberty to
proceed with the departmental proceedings and conclude the
same expeditiously.
Counter and Rejoinder Affidavits have been exchanged in
this case.
When the writ petition was filed in the year 2005, stay order
was given and, thus, after five years, we are of the view that
inquiry against the petitioner might have been concluded by
now and suspension matter of the petitioner might have been
decided. However, in the interest of justice it is directed that
if the enquiry proceedings against the petitioner has not been
completed till date, the same shall be completed within three
months from the date of receipt of a certified copy of this
order and the authority concerned shall pass final orders
within one month thereafter, as per law.
Subject to aforesaid observations, this writ petition is
disposed of finally.
