This writ petition has been filed against the orders dated 31.7.09 and 1.7.10
passed by the courts below. Vide order dated 31.7.09 II Additional Chief
Judicial Magistrate, Gautam Budh Nagar passed summoning order against the
petitioner in complaint case no.990/09, under Section 138, N.I. Act. When
this order was challenged in revision, that revision was dismissed by the
Additional Sessions Judge, Gautam Budh Nagar vide order dated 1.7.10.
Heard Mr. Bablu Singh, learned counsel for the petitioner, learned AGA
and perused the record.
Mr. Singh could not show any impropriety or illegality in both the orders,
hence, there is no scope to interfere with the orders and to allow this petition.
Consequently, the writ petition is dismissed.
However, it is expected that the court concerned shall decide the bail
application of the petitioner as per the law laid down in Lal Kamlendra
Pratap Singh Vs. State of U.P. and others, 2009(2) Crimes 4 SC.
