None appeared on behalf of the petitioner.
Heard Sri S.R. Shukla, learned Standing Counsel and perused the record.
By means of the present writ petition, the main relief as prayed by the
petitioner is as under:-
“(i) issue a writ, order or direction in the nature of Mandamus commanding
the opposite parties to make payment of the sums due towards the arrears of
salary alongwith increments with effect from 6.8.1993 till the date of death of
the husband of the petitioner namely, Somai Ram, his G.P. Fund, Gratuity,
Insurance, Leave Encashment and other dues and Pension to the petitioner
immediately alongwith interest at the rate of 20% per annum accrued on such
withholding to the petitioner;”
After hearing learned Standing Counsel and going through the record, I am of
the opinion that interest of justice will sub-serve in the present case, if the
petitioner is permitted to raise his grievance which he raised in the instant writ
petition for redressal before O.P. No. 2.
Accordingly, petitioner is permitted to make a fresh representation to O.P. No.
2 (Development Commissioner, Uttar Pradesh, Department of Rural
Development, Lucknow) within a period of three weeks from the date of
receiving the certified copy of this order annexing all the relevant documents
and materials in support of her case along with self addressed envelop and
after receiving the same O.P. No. 2 shall consider and dispose of the same by
way of speaking and reasoned order in accordance with law within a further
period of eight weeks thereafter communicate the same to the petitioner.
With the above observations, the writ petition is disposed of finally.
