The case of the petitioner in brief is that she applied and was allotted HIG
house no. 2/1620 area 248.60 sq. meter situate in Baudh (Budhi) Vihar,
Majhaula, Moradabad on 29-3-2006 by the letter dated 31-3-2006. The
petitioner has deposited the entire amount in 120 instalments. The last deposit
was made on 9-4-2007. Since then the petitioner has been running from pillar
to post to get the possession of the house in questin, but the respondents are
sitting tight over the matter.

The Estate Management Officer is required to appear in person on 15-2-2010
to answer as to why heavy damages should not be awarded against him for
inaction on his part to deliver possession of the house in question. It is made
clear that if in the meantime, the sale deed is executed and possession of the
house in question is delivered to the petitioner, he need not appear in person
on the date fixed.
