5. 29.10.2010 No one appears for the petitioner. Counsel for

the State is present.

Earlier this writ petition was dismissed for

default on 31.7.2007 and even when it was subsequently

restored by 28.01.2009 in MJC No. 1268 of 2008, today

same situation prevails. This Court would find that the

following prayer of the petitioner;

(A) For issuance of appropriate
writ, order or direction commanding the
respondents to appoint the petitioner on the
post of Head Master in a Govt. Middle
School in the District of East Champaran as
she fulfills the criteria to be promoted a
Head Master inasmuch as junior to her has
already been appointed and working as
Headmaster in a Govt. Middle School.

(B) For issuance of appropriate

writ, order or direction commanding the
respondents to give the petitioner an status
of B.A. trained teacher and other benefits
with effect from the date of publication of
result of her B.A. Examination.”

in fact now has to be considered in the light of

judgment of Full Bench in the case of Ram Nath Prasad

Singh vs. The State of Bihar & Ors., reported in 2009(3)

PLJR 384.

In that view of the matter, this writ application is

also disposed of in the same terms.
