3 06-09-2011 Heard learned counsel for the petitioners as
well as learned Additional Public Prosecutor for the state.
Petitioner No. 1 is mother-in-law whereas
petitioner No. 2 is husband of the deceased.
The contention of learned counsel for the
petitioners is that although, initially, the case was
registered under Sections-304(B), 201/34 of the Indian
Penal Code but after investigation, police submitted
charge sheet under Sections-306, 201/34 of the Indian
Penal Code and the court below has also taken
cognizance under the above-said sections which is evident
from Annexure-2 as well as Annexure-3 to this petition.
Taking into consideration the aforesaid facts
and circumstances as well as submission of the parties, let
the petitioners, namely, Smt. Kaushaliya Devi @
Kaushaliya Devi and Binod Rajak be released on bail on
furnishing bail bonds of Rs 10,000/- (ten thousand) each
with two sureties of the like amount each in connection
with Imamganj P.S. Case No. 09 of 2010 to the
satisfaction of Sri A.K. Gupta, Judicial Magistrate-Ist Class
(Sherghati) at Gaya.
