This appeal is filed against the judgment and order dated 11.4.1997 passed by
the IVth Addl. District Judge/Motor Accident Claims Tribunal, Fatehpur in
Claim Petition No. 213 of 1993.

The fact that the vehicle was involved is proved by the First Informatin
Report. The finding of the Tribunal suffers from factual inaccuracy therefore
the award is set aside. The Tribunal concerned is directed to decide the claim
on merit within a period of three months from the date of receipt of a
certified copy of this order.

The appeal is disposed of finally.
