Heard learned counsel for the parties.
Grievance of the petitioner is that in spite of entire dues which she has already
been paid, the respondents are harassing the petitioner for recovery of the
amount in question.
Learned counsel for the respondent submits that the liability to pay the said
loan money is on the petitioner’s shoulder. In case there is any controversy
with regard to the recovery of loan money, option for the petitioner to
approach the respondent no. 3 i.e. Mukhya Prabandhak, U.P. Sahkari Gram
Vikas Bank Ltd.,Hazaratganj, Lucknow who shall look into the matter and
decide the controversy involving disputed question of facts.
Accordingly, liberty is given to the petitioner to represent her cause before the
respondent no. 3 i.e. Mukhya Prabandhak, U.P. Sahkari Gram Vikas Bank
Ltd., Hazaratganj, Lucknow within two weeks from today. In case, such
representation is submitted, the respondent no. 3 consider and decide the same
after providing due opportunity of hearing in accordance with law by passing
a speaking and reasoned order expeditiously and preferably, within three
months from the date of receipt of a certified copy of this order and
communicate decision. For a period of three months or till disposal of
representation whichever is earlier, status-quo shall be maintained.
Subject to above, the writ petition is finally disposed of.
No order as to costs.
