In the present case statutory complaint has been made against the petitioner as
is envisaged under Rule 3 of 1997 Rules. On the said statutory complaint
being made, District Magistrate in his wisdom has appointed inquiry officer to
conduct preliminary inquiry. At this juncture present writ petition has been
filed.
Learned counsel for the petitioner has tried to contend that even in the past
complaint has been made and said complaint has been found to be
untruthfulness and in this background second inquiry is nothing but
harassment and victimization. Report has been submitted on the earlier
occasion and complaint has been made second occasion has been perused.
Charges are identical, and as such inquiry directed against the petitioner is
correct, as such this court refuses to interference with the same.
Consequently present writ petition is dismissed.
