We have heard learned counsel for the petitioners and learned standing
counsel appearing for respondents no.1 to 4.
Petitioner no.1 is aged about 21 years and petitioner no.2 is aged about 32
years. Learned counsel for the petitioners has also produced identity card
issued to petitioner no.1 by the Election Commission of India wherein the
year of birth of petitioner no.1 has been mentioned as 1989. A photostat copy
of this card be kept on record. They have stated that they have married each
other on 20.07.2010 Idgah Masjid, Hospital Road, Gulab Devi, Bareilly. A
copy of the nikah nama has been filed as Annexure-3 to the writ petition.
Both the petitioners have stated that they have married each other and are
living peacefully as husband and wife but the police authorities are harassing
them. Both the petitioners appear to be major and it is open to a major person
in this country to live freely with any one and to marry any person of his
choice. Since the petitioners are major and have stated that they have married
each other, we direct the police authorities to ensure that the petitioners be not
harassed in any manner either by the police authorities or by any other person
and the petitioners may be permitted to live peacefully as husband and wife.
With the aforesaid directions this writ petition is finally disposed of.
Office is directed to issue a certified copy of this order to learned counsel for
the petitioners on payment of usual charges today.
