Heard learned counsel for the petitioners and learned Standing
Counsel.
Petitioners who are working on the post of Aaganwari Sahayika
claim that in view of the advertisement dated 1st July, 2010 as in
the block where the petitioners are working, 44 vacancies have
been declared, therefore, according to the Government Order 25%
of the vacancies have to be filled up amongst the candidates who
are working on the post of Aaganwari Sahayika having experience
of five years with satisfactory work. Petitioners allege that they
have completed five years of service and, therefore, according to
the Government order they are entitled to be considered for the
post of Aaganwari Karyakatri in view of the vacancy advertised on
1st July, 2010. The petitoiners submitted an application to this
effect before the District Magistrate, respondent no. 2, but no
decision has been taken, hence the present writ petition.
After considering the submission of learned counsel for the
petitioners, as the claim of the petitioners is still pending for
consideration and on the basis of the advertisement dated 1st July,
2010, no final selection has been taken, therefore, in my opinion, it
will be appropriate that the respondent no. 2 may take a decision
regarding promotion of the petitioners on the post of Aaganwari
Karyakatri taking into the Government Order issued by the State
Government according to law, if possible, within a period of six
weeks from the date of production of a certified copy of this order.
The writ petition is disposed of accordingly.
No order is passed as to costs.
