Background
1. The Applicant filed an RTI application dt.24.9.08 with the CPIO, M/o Railways
requesting for additional information to the information already provided to the CPIO
by the RTI Cell seeking information against 15 points related to the recommendations
of the Pay Commission. On not receiving any reply from the CPIO, she filed a first
appeal dt.10.11.08 with the Appellate Authority stating that she did not receive any
reply despite the fact that the application was registered vide F.No.RTI Cell/2008/1297
and marked to US(E) on 29.9.08. On still not receiving any reply, she filed a
complaint dt.23.1.09 before CIC stating that she has yet to receive the information
despite sending a reminder to the Public Authority on 30.12.08..
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
for November 27, 2009.
3. Both the Complainant and the Respondent were not present during the hearing.
Decision
4 The Commission directs the CPIO to provide the point wise information to the
Complainant on the basis of records available with him. If not, the non availability of
information, pointwise to be indicated.
5. The information should reach the Complainant by 28.12.09.
6. The Commission directs the CPIO cum US(E) to show cause as to why a penalty of
Rs.250/- per day (Maximum Rs.25000) should not be levied on him for not responding
to the RTI application within the stipulated period as given in the Act. He is directed
to submit his explanation in person on 19.1.10 at 2.30 pm
7. The appeal is disposed off with above directions.
