Court No. - 38 Case :- WRIT - A No. - 39239 of 2010 Petitioner :- Smt. Sanju Mishra Respondent :- State Of U.P. And Others Petitioner Counsel :- B. M. Pandey Respondent Counsel :- C. S. C.,Santosh Kr. Mishra Hon'ble Shishir Kumar,J.
Heard learned counsel for the petitoiner and learned Standing
Counsel.
Petitioner alleges himself to be one of the applicant for the post of
Anganwari Karykarti. According to the petitioner, the forged
income certificate was submitted by the respondent No.5 a
complaint to that effect was given by the petitioner to the relevant
authority, but no attention was made and respondent No.5 has been
given appointment. The respondent No.4 has also directed to
respondent No.3 to make an inquiry regarding the complaint of the
petitioner. But the same has not been done and no decision has
been taken up-till-date.
I have considered the submission of the learned counsel for the
petitioner and perused the record. As the respondent No.4 has
directed to consider the issue regarding the genuineness of the
documents on the basis of the report obtained from the Sub-
ordinate authority, therefore, in my opinion respondent No.4 may
be directed to decide the claim of the petitioner, which is pending
according to the petitioner by a speaking and reasoned order after
affording opportunity to the relevant parties within a period of two
months from the date of production of certified copy of this order.
The writ petition id disposed of accordingly.
No order as to costs.
Order Date :- 8.7.2010
