Heard learned counsel for the petitioner, learned Standing counsel for State-
respondents, Sri Arvind Kumar, learned counsel for respondent no. 5 and Sri
R.P. Shukla appearing for respondent no. 7.
The petitioner is aggrieved by the selection and appointment of respondent
no. 6 on the post of Shiksha Mitra. The Government Order dated 24.04.2006
provides that whenever any dispute with regard to selection and appointment
of Shiksha Mitra is raised, the District Magistrate after receiving complaint
from the aggrieved person shall consider and decide the same after making
necessary inquiry giving opportunity to all concerned persons. In view of the
said provisions, the petitioner has an alternative remedy which is equally
efficacious. Therefore, I am not inclined to entertain this writ petition at this
stage.
The petitioner is given liberty to approach the District Magistrate concerned
by making appropriate representation raising her aforesaid grievance and in
case such a representation is made by the petitioner within two weeks from
today the District Magistrate concerned shall consider and decide the same in
accordance with law after affording opportunity to all concerned persons by
passing a reasoned and speaking order within a further period of two months.
With the above observation, the writ petition is disposed of.
