Since all these petitions as per Schedule appended herewith involve common question, hence at joint request, were heard together and are being disposed of by present order.
Instant bunch of petitions relates to transfer of Teachers, who are member of Rajasthan Panchayati Raj Service Rules, 1996 and have been transferred under the Scheme of Rationalization introduced by the Government within same Panchayat Samiti from one institution to the other.
It has been informed by counsel for the respondent-State Mr.N.A.Naqvi, AAG that in the light of judgment dt.13/07/2010 delivered at main seat Jodhpur in Badur Ram Khileri Vs. State & Ors (S.B.Civil Writ Petition-5784/2010 & 69 other connected writ petitions), State Government vide order dt.22/07/2010 has taken decision to withdraw such transfers of Primary School Teachers/petitioners who have been transferred within Panchayat Samiti.
In the light of the decision taken by the respondent-State, (supra), instant writ petitions alongwith stay petitions as per Schedule appended herewith relating to transfer of petitioners within Panchayat Samiti by State Government, stand allowed and their respective transfers are hereby quashed & set aside and the respondent-State is directed that all such petitioners who are affected on being transferred within same Panchayat Samiti may now be restored to their respective position without any further delay. However, it will not preclude the respondents from passing fresh orders in the interest of administration if required in accordance with law. No order as to costs.
