The petitioner is claiming to be the cousin sister of the deceased
government servant, who died along with his family in a tragic
accident. She claims to be the only heir of her cousin brother and
is now claiming service dues, as legal representative of late Shri
Radhey Shyam Chaudhary.
The petitioner had applied for succession certificate. The
application, however, was confined only to Rs.2,22,000/- of a
LIC policy.
We do not find that the respondents have committed any error in
refusing to release the retirement dues, until the succession
certificate is obtained or succession certificate already obtained is
amended including the service dues also. The petitioner’s
entitlement to the service dues as cousin sister can be verified
only after she obtains valid certificate including service dues.
Let the petitioner apply for and obtain amendment of the
succession certificate to be decided by the competent court in
accordance with law.
List this matter after two months.
