Facts
:
1. Both the parties were heard on 12th August, 2010.
2. During the hearing, the details of information asked for and CPIO’s
response were discussed. Through her RTI application, the appellant has
agitated against the implementation of certain policies of the respondent,
because of which the appellant’s business is adversely affected. She has sought
to know as to what action has been taken on her representations. The CPIO has
replied, with which the appellant is not satisfied. Hence, this appeal before the
Commission.
Decision:
3. There is no denial of information under section 8 (1) of the Act. An
information seeker is expected to ask for information as per section 2 (f) of the
Act, which requires that the information should be available in any material form.
A requester should not seek opinion or views of the CPIO, as has been

attempted in the instant case. The appellant is therefore advised to seek
inspection of relevant records and files u/s 2 (j) of the Act so as to clearly specify
the information, which should be provided as per the provisions of the Act. Both
the parties should mutually decide a convenient date and time for inspection of
relevant records within 15 days from the date of receipt of this decision.
4. With these observations, this appeal is disposed of.
