Heard learned counsel for the petitioners and the learned Additional
Government Advocate.

Under challenge in the instant writ petition is FIR relating to Case Crime No.
1413 of 2009, under Sections 419, 420, 467, 468, 504 and 506 IPC, police
station Kotwali Nagar, district Bahraich.

We have gone through the FIR, which discloses commission of cognizable
offence and, as such, the same cannot be quashed.

The writ petition is misconceived and is accordingly dismissed.

However, it is provided that if petitioner no. 1- Smt. Urmila Devi being a
lady surrenders and moves application for bail, the same shall be considered
and disposed of by the courts below by giving benefit of Section 437 Cr.P.C.
