Learned Standing Counsel has accepted notice on behalf of the respondent
nos. 1 to 4 and Sri Harish Kumar Tripathi has entered appearance on behalf of
caveator.
It has been contended on behalf of the petitioner that in the present, to the
show cause notice adequate reply has been submitted and said reply has not at
all been adverted to in its correct perspective, opinion has been formed. In
pith and substance petitioner submits that purpose of submitting reply thus
stands frustrated. Petitioner’s contention is that inquiry which has been
undertaken is in breach of provision of 1997 Rule.
In respect of issues as to whether opportunity should be afforded to the
incumbent whose financial power has been ceased, the matter has been
referred to larger bench.
Consequently, in the facts of the present case, record of the present writ
petition be also connected along with record of Civil Misc. Writ Petition No.
60951 of 2009 and Civil Misc. Writ Petition No.49305 of 2009 and interim
order be extended to petitioner also, which has been extended in the
aforementioned writ petition,on the same term and condition. .
