In this writ petition, the petitioners have prayed for a direction on the
respondents to appoint them on regular basis on the vacant post of Messenger/Sepoy
in accordance with the direction of National Bank for Agriculture and Rural
Development(NABARD for short).
It has been stated that the petitioners have been working as Messenger on part-
time basis since the year 1990 in Jharkhand Gramin Bank, Chatro-Chatii, Gomia and
Chas respectively. The Jharkhand Gramin Bank was initially known as ‘Giridih Regional
Gramin Bank’ established in the district of Giridih. NABARD framed a policy for
regularization of part-time employees of the Rural Banks. Accordingly the petitioners
and other similarly situated persons were called for interview. The petitioners along with
other candidates appeared in the interview on 4.8.1991. Thereafter, a select panel of
41 candidates, including the petitioners was prepared on 22.01.1992. Appointment on
regular basis in the Gramin Bank was to be made in accordance with the said panel.
Some of the similarly situated persons were also regularized in view of the said policy
decision of NABARD, but inspite of repeated requests and representations, the
petitioners have not been regularized till date. Earlier, some of the Banks denied the
regularization of the candidates named in the panel on the pretext that the panel stands
expired. The aggrieved persons had moved before the Patna High Court, Ranchi
Bench, Ranchi (as then was) in C.W.J.C. no.2643 of 1992(R). The said writ application
was decided holding that the panel was alive and the concerned Banks cannot deny
validity of the panel. The respondents, thereafter, preferred appeal being L.P.A. no.360
of 1999(R) against the order passed in the said writ application, but the said appeal had
also not been decided in favour of appellants. It has been submitted that the petitioners
after disposal of L.P.A. no.360 of 1999(R), again approached the Bank authorities but
their claim has not been considered and no order has been passed.
Considering the above and also considering that the Bank has not passed any
order on the claim of the petitioners, it is desirable that the authorities of the concerned
Bank must dispose of the petitioners’ representation.
In view of the above, this writ petition is disposed of giving liberty to the
petitioners to file fresh representation before the Regional Manger, Jharkhand Gramin
Bank, Giridih-respondent no.4, who is said to be competent authority. On receipt of
petitioners’ representation, the said respondent shall consider the petitioners’ claim and
pass appropriate order in accordance with law.
