Submission on behalf of applicants is that civil litigation is already
going on and second appeal is pending in the High Court.

Learned A.G.A. has accepted notice on behalf of opposite party
Nos. 1 and 2.

Issue notice to opposite party no. 3 returnable at an early date.
Counter affidavit may be filed within three weeks from the date of
receipt of notice. Rejoinder affidavit may be filed within three
weeks thereafter.

List after expiry of the aforesaid period before the appropriate
Court.

Till the next date of listing, further proceedings in Case No. 269 of
2010, arising out of case Crime No. 612 of 2009, under Sections
420, 467, 468, 471 I.P.C., Police Station Khair, District Aligarh,
shall remain stayed.
