Order on C.M. Delay Condonation Application No. 99716 of 2008
This second appeal has been listed today along with Second Appeal No. 310
of 2006.
Delay condonation application filed along with second appeal has been
opposed by Sri Pankaj Agrawal holding brief of Sri M.K. Gupta, appearing
for the respondent.
In the connected second appeal stay order has already been granted and on
this basis learned counsel for the appellant in the present case also claimed
interim order.
Sri Pankaj Agrawal submits that respondents 6, 7 and 8 in second appeal no.
310 of 2006 against whom decree is there have not filed appeal in this court
and, therefore, stay granted by this court is to be confined only in respect to
the present appellant in appeal no. 310 of 2006.
Considering contention of both the parties, delay condonation application is
allowed. Office is directed to allot regular number in the present second
appeal.
Since there is already an interim order in connected Second Appeal No. 310
of 2006, an interim order shall also be operative in this second appeal till the
next date of listing.
List after six weeks along with connected second appeal no. 310 of 2006.
