AUGUSTINE GEORGE MASIH,J. (ORAL)

Counsel for the petitioner contends that the petitioner

has moved a representation (Annexure P-3) to the respondents and

respondent No.3- Chief Engineer, Chandigarh Housing Board, Sector

9, Chandigarh, would be the competent authority to take a decision

thereon. He contends that the post of Junior Engineer is still lying

vacant and earlier vacancy already stood fulfilled by a person, who

was junior to the petitioner. Earlier also a representation dated

3.7.2009 was submitted by the petitioner, which has also not been

decided till date and, therefore, he prays that a direction may be

issued at this stage to respondent No.3 to consider and decide the

legal notice dated 4.12.2010 (Annexure P-4) sewed by him within

some specified time.

Civil Writ Petition No. 6567 of 2011 -2-

Without going into the merits of the case nor commenting

thereon the writ petition is disposed of with a direction to respondent

No.3-Chief Engineer, Chandigarh Housing Board, Sector 9,

Chandigarh, to consider and decide the legal notice dated 4.12.2010

(Annexure P-4) submitted by the petitioner, putting forth his claim

therein, within a period of one month from the date of receipt of

certified copy of this order.

Petition stands disposed of accordingly.
