2 19.10.2011 This is an application for restoration

of Cr.Misc.No. 43894 of 2008 which stood

dismissed on 3.8.2011 for non-prosecution on

behalf of petitioner.

However, it is submitted that due to

mistake on the part of the Advocate Clerk, the

cause list could not be marked on 3.8.2011, as a

result of which when the case was called out, no

one could attend the Court and dismissed for

want of prosecution. As such, it is prayed that

the case be restored to its original file.

In view of submissions, the restoration

application is allowed and Cr.Misc.No. 43894 of

2008 is restored to its original file.
