Petitioner claims that writ petition No. 45179 of 2007 in
respect tot he land in dispute is pending.
Order of this court dated 19.9.2007 speaks the ground on
which stay was given which is to the effect that plot is not
mentioned under the Land Acquisition Act.
Here is the matter where Secretary Development Authority
rejected compounding application pursuant the direction of
this court given on 11.1.2010 in writ petition No. 46259 of
2009 . A finding has been recorded that petitioner has no
concern with the land in dispute.
There appears to be dispute of identity of pot no. 1032/2 and
1032/4/3. Various sale deeds and the orders of civil court
are referred in the impugned order.
Order impugned can be otherwise appealed as that has
been passed by the Secretary Development Authority or in
respect to the rights and title dispute can be adjudicated
before the competent Civil Court.
Be as it may, on these facts this court as on date is not
inclined to grant any relief but at the same time as petitioner
claims that writ petition No. 45179 of 2007 is pending, list
this case along with the writ petition, referred above, in the
week commencing 19th July, 2010.
