IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 31044 of 2009(A) 1. SONIYA JOSE, AGED 23 YEARS, D/O JOSE, ... Petitioner Vs 1. UNIVERSITY OF CALICUT, ... Respondent 2. THE CONTROLLER OF EXAMINATIONS, For Petitioner :DR.GEORGE ABRAHAM For Respondent : No Appearance The Hon'ble MR. Justice P.N.RAVINDRAN Dated :02/11/2009 O R D E R P.N.RAVINDRAN, J. --------------------------- W.P.(C) No. 31044 OF 2009 -------------------------- Dated this the 2nd day of November, 2009 J U D G M E N T
Heard Dr. George Abraham, the learned counsel appearing for
the petitioner and Sri. P.C.Sasidharan, the learned standing counsel
appearing for the Calicut University.
2. The petitioner is a final year B.Sc Nursing student of
Crescent College of Nursing, a college affiliated to the University of
Calicut. She appeared for second year B.Sc examination in Nursing
conducted by the University of Calicut in March 2009. The results
were published in October 2009. The petitioner failed in the paper
Surgical Nursing including O.R. Technique. She has therefore
applied for revaluation of her answer script by submitting Ext.P1
application, scrutiny of her answer script by submitting Ext.P2
application and for a Photostat copy of the answer script by
submitting Ext.P3 application, all dated 27.10.2009. It is stated that
the requisite fee has also been paid. Reliance is placed on
Exts.P4, P5 and P6 receipts in support of the said submission. The
petitioner submits that the third year examinations are scheduled to
commence on 11.11.2009 and that unless her answer script is

2
revalued expeditiously she will not be in a position to appear for the
said examination. It is stated that she had done well in the
examination and is hopeful of securing a pass. On these grounds,
the petitioner seeks a direction to the respondents to take steps to
revalue her answer script and to communicate the result to her
expeditiously.
3. The result of the second year B.Sc degree examination in
Nursing, for which the petitioner appeared for, was published only in
the last week of October, 2009. The petitioner applied for revaluation
on 27.10.2009. Apart from merely alleging that unless the petitioner
passes the second year examination she would not be permitted to
appear for the third year examination, no such regulation has been
brought to my notice. However the third year examination is
scheduled to be held on 11.11.2009, within another nine days from
today. It will not be possible for the University to revalue the
petitioner’s answer script and to publish the result before the said
date.
4. Sri.P.C.Sasidharan, the learned standing counsel appearing
for the Calicut University however submits that the University will

3
revalue the petitioner’s answer script and communicate the result to
her expeditiously, if her application is otherwise in order. As regards
scrutiny and the request for a photostat copy of the answer script, the
learned standing counsel submits that scrutiny can be arranged and
held expeditiously and a photostat copy will also be issued forthwith.
I accordingly dispose of this writ petition with a direction to the
respondents to take steps to have the petitioner’s answer script
described in Ext.P1 application revalued and to communicate the
result to her within two months from the date on which the petitioner
produces a certified copy of this judgment before the Controller of
Examinations, University of Calicut. The Controller of Examinations,
University of Calicut, shall within two weeks from the date on which
the petitioner produces a certified copy of this judgment before him
also make arrangements for scrutiny of the answer script. The
Controller of Examinations shall also issue to the petitioner a
photostat copy of the answer script described in Ext.P3 application.
