By means of this writ petition, petitioner has prayed for a
writ, order or direction in the nature of mandamus directing
the respondents to provide necessary police force and
implement the injunction order dated 7.8.2008 passed b y
learned Civil Judge, (S.D.), Varanasi by getting the boundary
wall raised on the spot in pursuance of the letter dated
24.9.2009 issued by the learned Civil Judge, (SD) Varanasi
within a week.
Considering the facts and circumstances of the case, but
without prejudice to the merits of the case, petitioner is
directed to move a representation/application afresh before
respondent no. 2 who shall decide the same by a speaking
order in accordance with law, if possible within a period of
one month from the date of receipt of certified copy of this
order. Petitioner shall be afforded an opportunity of hearing
by the concerned authority before passing the order. The
concerned authority after taking decision on the
representation of the petitioner will communicate the same
to the petitioner.
With the aforesaid observation the writ petition is finally
disposed of.
