J U D G M E N T
In the 2nd professional examination of BAMS, petitioner failed
in the subject Rogavinjanam and Vikritivinjanam. She appeared in
the supplementary examination held in October, 2009, when also
she failed. Thereupon she applied for revaluation and the
complaint is that the revaluation is inordinately delayed.
Petitioner also submits that the 3rd professional examination is to
commence on 26.5.2010 and pending finalization of the
revaluation she should be permitted to appear for the
examination.
2. If as stated by the petitioner, Ext.P3 application for
revaluation filed by her has been received and is pending,
necessarily respondents should expedite the same and declare
the results as expeditiously as possible. This shall be done at any
rate within 6 weeks from the date of receipt of a copy of the
judgment.
3. In so far as the request of the petitioner to permit her to
appear for the 3rd professional examination is concerned, as per
WPC.No. 14119/2010
:2 :
the regulation of the University unless a candidate has
successfully passed the entire subjects in the 2nd professional
examination, such candidate is ineligible to appear for the 3rd
professional examination. As on date since the petitioner has not
passed the entire 2nd professional examination this court will not
be justified in allowing the said request.
4. Writ petition is disposed of as above.
Petitioner shall produce a copy of the judgment along with a
copy of the writ petition before the respondents for compliance.
