ORAL ORDER

Heard Mr. Desai ld. counsel for petitioners,
Mr. Y.M.Thakkar ld. AGP for respondent No. 1 & 2 and
Mr.Patel ld. counsel for Respondent No. 3.

The grievance of the petitioners is that, there
has been discriminatory treatment-qua-them, because
though the Government teachers have got the exemption
from paying the Stamp Duty for House Building Advance
Agreements, they have not got this benefit. The question
regarding discriminating treatment probably may not
survive, looking to the provisions contained under
Section-9 of the Bombay Stamp Act, 1958, under which
specific orders would be required. The petition,
therefore, stands rejected. Anyhow, it shall be open to
the petitioners to approach the respondent No. 3 herein
with the necessary representation within a period of two
weeks, which should be considered by the said respondent

within a further period of six weeks. What all I have
stated while rejecting the present petition should not
come inthe way of the petitioners, while they pray for

sympathetic consideration from the said
respondent. Petition stands rejected, with the above
said observations. Notice shall stand discharged.
