Petitioner claims to be an owner in possession of

20.25 cents of property, which is covered by Exhibits P1

and P2 documents. It seems that the property was

mortgaged in favour of the 1st respondent Bank and the

Bank after obtaining a decree brought the property to

sale. Petitioner contends that the property is worth Rs.50

lakhs and was sold only for an amount of Rs.16,15,000.

Since the sale has been held under the orders of the Civil

Court, it is up to the petitioner to approach the Civil

Court itself for setting aside the sale. With liberty to the

petitioner to do so, the writ petition is disposed of.
