2. 5.7.2010 Heard learned counsel for the petitioner and the

respondent-Bank.

The grievance of the petitioner is that upon his

voluntary retirement on 29th of January, 2007, all his retiral dues have

not been settled even though the Bank has sanctioned for payment of

the gratuity and the amount of leave encashment. Besides the above,

although the arrears of salary have been sanctioned, but the same has

not been paid till date.

Learned counsel appearing for the respondent-Bank

submits that the grievances of the petitioner shall be considered by the

Bank as per the extant rules.

In the above circumstances, learned counsel for the

petitioner submits that although the petitioner had represented his

grievances earlier by filing a representation, however, for expeditious

disposal of his unpaid claims as highlighted in this writ application,

the petitioner proposes to file a fresh representation before the

Managing Director, Bihar State Co-operative Land Development

Bank Ltd., Patna (respondent no.2). In case such a representation is

filed stating the details of his unpaid claims as also enclosing the copy

of the relevant documents, if any, in support of such claims along with

the certified copy of the present order within a period of four weeks,

the grievances of the petitioner with regard to the payment of retiral

dues as raised in his representation be considered in accordance with

law expeditiously, preferably within a period of four months on

receipt of such representation, so that the grievances of the petitioner

may be settled and the admitted retiral dues may also be paid with

statutory interest permissible under the rules without further delay.

However, with regard to the other claims, the same may also be

considered as per the policy decision of the Bank and the payments be

made in terms thereof.

The writ application stands disposed of with the above

observations/directions.
