                     JUDGMENT

The petitioner challenges Ext.P5 order of

transfer, by which he has been transferred from

Thiruvananthapuram to Punnayur. The petitioner is

a Deputy Manager in the State Bank of India, who

was promoted from MM Grade II to MM Grade III.

This has entailed a transfer. This court had

required the bank authorities to consider whether

the petitioner could be accommodated in

Thiruvananthapuram until he is in a position to

travel, taking note of the fact that he had met

with an accident and was under treatment for the

fracture. Apparently, taking note of this order

passed by this court, the Chief General Manager,

has passed an order, which reads as follows:

“However, considering the spirit of the

order passed by the Hon’ble Court, the

petitioner may be temporarily parked in

a supernumerary post in the

Administrative Wing I, Local Head

Office Annex, Trivandrum till 15th July,

2008, if he is fit to report for duty.

This is only a temporary arrangement,

made without prejudice to the

contentions raised by the Bank in the

above Writ Petition. We would not be

considering further extension of time

beyond 15th July, 2008. It is also

made clear that the petitioner shall

not be entitled to any deputation,

halting or any other allowance in

this regard.”

2. In the circumstances, I do not think

that there is any further grievance to be

addressed in this writ petition. Accordingly,

the respondents are directed to permit the

petitioner to continue in Thiruvananthapuram

till 15.07.2008. The order of transfer can be

given effect to, subsequent thereto. But, I make

it clear that this direction will not stand in

the way of the petitioner in moving for

variation of the order of transfer, availing

suitable remedies in terms of the Regulations

applicable to the managerial staff of the bank.

Subject to the above, the writ petition

is disposed of.
