3 25/02/2011 The claim of the petitioner is that he was appointed in
the year 1986 in the S.S.B.K. Sanskrit High School, Buxar. It is
further contended that the strength of the School is 7 plus 2 and
that the petitioner was regularly working in the said school and
his name was recommended by the Bihar Sanskrit Shiksha
Board for consideration and confirmation.
On the other hand, a counter affidavit has been filed
on behalf of the District Education Officer annexing the
attendance register of the School which indicates that the
petitioner has not signed on the attendance register. It is,
further, submitted on behalf of the State that in fact the
petitioner is not working in the School.
In the facts aforesaid, this Court cannot come to a
conclusion that in fact the petitioner was regularly working in
the said School.
This application is accordingly dismissed.
