Heard learned counsel for the petitioners.
Notice on behalf of opposite parties no.1 to 3 has been accepted by the
learned Standing Counsel, who prays for and is granted four weeks’ time for
filing counter affidavit. Petitioners may file rejoinder affidavit within two
weeks thereafter.
List after expiry of the aforesaid period.
Submission of the learned counsel for the petitioners is that the Prescribed
Authority has passed an ex-parte order against the petitioners. The petitioners
though filed written statement but could not participate in the proceedings on
account of their ailment, therefore, after passing of the order by the Prescribed
Authority they moved restoration application and the restoration application
too has been rejected by the Prescribed Authority without giving any
opportunity to the petitioners to adduce evidence in their support.
In these circumstances, operation of the orders dated 17.5.2010 and 18.2.2009
shall remain stayed till the next date of listing.
