Heard learned counsel for the petitioner.

By this petition, petitioner has prayed for a writ of mandamus commanding
the respondents to decide Suit No.431 of 2009 (Shishpal vs. State of U.P. and
others) expeditiously.

The suit has been filed only in the year 2009 and large number of cases filed
even earlier to 2009 are waiting for their turn. No exceptional circumstances
has been made out in the facts of the present case to issue such direction.
However, we observe that it will be open for the petitioner to make
appropriate application for early disposal of the suit before the same Court.

The writ petition is dismissed of with the above observation.
