17. 23.08.2011 Heard the learned SC-6 Mr. J.S. Arora on
behalf of the appellant and the learned counsel Mr. Kumar
Hari Narain Singh on behalf of the cross-objector
respondent on the cross objections.
It appears that all these first appeals have
already been disposed of by the Lok Adalat at Patna held
on 19.8.1997. The award of the Lok Adalat reads as
follows :
“In this appeal coming up before this Lok
Adalat today, the dispute between the
parties have been resolved. The appellant
agrees to withdraw the appeal.
This appeal as agreed between
the parties is dismissed.
The matter may now be placed
before the Court.”
In view of the award of the Lok Adalat it
appears that with the consent of both the parties and on
the basis of compromise the Lok Adalat has disposed of
the appeals.
In such view of the matter, now the learned
counsel appearing on behalf of the respondents submitted
that since on compromise the matter has already been
disposed of no separate award contrary to the decree can
be passed by the appellate court. The cross objector
submitted that he is not pressing the cross objections.
Therefore, all the cross objections in all these first appeals
are dismissed as not pressed.
Accordingly, these appeals stands disposed of.
