We are of the view that in view of the finality

attained by the judgment in L.A.R.17/95 relied on by

the Reference Court by judgment of this Court in

L.A.A.539/09, there is no warrant for entertaining this

appeal any longer. The appeal is dismissed. No costs.

The Cross Objection is dismissed for default.
