                                JUDGMENT

Pius.C.Kuriakose, J.

Having gone through the impugned judgment, we are of the view that

the learned Subordinate Judge was perfectly justified in relying on Ext.A3

which was a judgment of the same Sub court in L.A.R.No.130/1997. We

have today by judgment in L.A.A.No.424/2008 upheld the above judgment –

Ext.A3 in L.A.R.No.316/1997. In view of our decision in

L.A.A.No.424/2008, we do not find any warrant for entertaining this appeal

further. The Appeal will stand dismissed.
