In this case, learned counsel for the accused respondent has
submitted that respondent has died.
Record was called from the C.J.M. Fatehpur, who after police
enquiry and departmental enquiry, has submitted his report that
respondent has died on 30.9.2009. Learned AGA does not dispute
this fact.
In view of the above, Government Appeal has become infructuous
and is accordingly dismissed.
Office has sent the copy of the Government Appeal No.4842 of
2009 as 2nd Judge copy which is completely different matter.
Office is directed to abstain such type of practice otherwise the
Court will take strict action against the Officer concerned. The said
file should be tagged with the appropriate case.
