ORAL
ORDER

(Per
: HONOURABLE MR.JUSTICE JAYANT PATEL)

1. The
present application for leave to prefer appeal is directed against
the judgment and order dated 12.8.2009 passed by the learned Special
Judge in Special Case (ACB) No. 21/1994, whereby, the accused have
been acquitted for the offence under sec. 7, 12, 13(1)(d) read with
sec. 13(2) of the Prevention of Corruption Act.

2. Considering
the facts and circumstances, it appears to us that there is a good
case to be considered in the appeal. Hence, leave deserves to be
granted and, therefore, granted. Application stands disposed of
accordingly.

PATEL, J.) (Z.K.SAIYED, J.)
