The
present application for leave to prefer appeal is directed against
the judgment and order dated 29th July 2009 passed by the
learned Sessions Judge in Sessions Case No.199 of 2006, whereby the
accused has been acquitted for the offences under Section 307 of the
Indian Penal Code read with Section 135(1) of the Bombay Police Act.
Considering
the facts and circumstances, it appears to us that it is a good case
to be considered in appeal. Hence, leave deserves to be granted and,
therefore, granted. The application is disposed of accordingly.
