Present
application has been filed by the applicant ? State of Gujarat to
condone the delay of 76 days in preferring Criminal Appeal
challenging the judgment and order dated 13.5.2005 passed by the
learned Additional Sessions Judge & Joint District Judge, Fast
Track Court No.4, Bharuch passed in Sessions Case No.113 of 2003.

Having
heard Shri K.P.Raval, learned APP appearing for the applicant ?
State and Shri Sunil Mehta, learned advocate appearing for Shri
S.K.Bukhari, learned advocate appearing for the opponents herein ?
original accused and having gone through the averments in the
application and the judgment and order passed by the learned trial
Court and considering the fact that there is a delay of 76 days and
that the State is given an opportunity to submit the case on merits,
delay of 76 days in preferring the Criminal Appeal is hereby
condoned.

Rule
is made absolute accordingly.
