In
view of the discussion taking place today between learned counsel
Mr.B.A.Vaishnav and Mr.J.P.Bhatt, appearing for the respondents, and
learned AGP Mr.Janak Rawal, appearing for the appellants, it is found
to be necessary and in the interest of expeditious disposal of these
proceedings to call for relevant files of appellants with responsible
officer to place the correct facts before the Court. It is generally
conceded that neither the appellants nor learned counsel for the
respondents are in touch with most of the respondents, some of whom
are stated to have passed away. Therefore, it is directed that
responsible officer in the office of Secretary to the State
Government in the Home Department and responsible officer in the
office of Director General of Police shall remain personally present
on the next date of hearing before this Court with the relevant
record and information about compliance of successive orders pursuant
to the judgment dated 12.12.1996 of learned single Judge in SCA
No.688 of 1992 and other allied matters, which is impugned herein.
Hearing
is adjourned to 03.12.2010.
A copy of this order shall be given to learned AGP today.
