ORDER

By
way of present application, the applicant-State has inter alia
prayed to cancel the order dated 23rd November 2010
passed by the learned Additional Sessions Judge (Fast Track Court),
Bhuj-Kachchh in Criminal Miscellaneous Application No.463 of 2010 by
which the learned Judge was pleased to release the respondent on
regular bail.

Heard
Mr.R.C. Kodekar, learned Additional Public Prosecutor for the
applicant-State.

Mr.Kodekar
has contended that the order passed by the learned trial Judge is
illegal, arbitrary and without properly appreciating the facts of
the case and material produced on record of the case. He has also
contended that the respondent by giving false promise collected
Rs.2,30,000/- and in furtherance, the applicant had also issued
forged and bogus certificate bearing signature and seal of the
Officer of the Central Government. He, therefore, prayed to set
aside the order of granting bail to the respondent.

I
have perused the papers produced before me as well as submissions
advanced by the learned counsel for the party.

From
the perusal of the papers it appears that the learned Judge has
passed absolutely just and proper order. The learned trial Judge has
after appreciating all the evidence on record, passed the order. I
have not found any substance in the present application. Hence, the
present application deserves to be dismissed and is hereby
dismissed.
