1.0 Present
application is filed seeking condonation of delay of 13 days, caused
in filing the appeal.

2.0 Rule
was issued by this Court on 4th April 2011, returnable
today i.e. 9th May 2011.

3.0 Learned
Special Additional Public Prosecutor Mr. Panchal states that except
respondent no. 8, who has expired, all other respondents are served.
Learned advocates Mr. SP Majmudar and Mr. PP Majmudar have filed
their appearance for respondent no. 12. Though served, nobody
appears.

4.0 For
the contents of the application and the submissions made by the
learned Special Additional Public Prosecutor, the same is allowed.
Delay is condoned. Rule is made absolute.
