We
have heard Mr N J Shah, learned AGP for the appellants and Mr B.S.
Brahmbhatt, learned counsel for the respondents. This intra-court
Letters Patent Appeal has been filed challenging the judgment dated
11.11.2009 passed by the learned Single Judge in Special Civil
Application No.16720 of 2007. The petition has been allowed and the
State Government has been directed by the learned Single Judge to
consider the application of the petitioner after applying its mind to
the facts of the case and in view of the observations made, in
accordance with law within a period of three months and it has
further been directed that the decision shall be communicated to the
petitioner. Since the matter has
yet not been decided by the authority, we are not inclined to
interfere with the matter at this stage. This LPA is accordingly
dismissed.
