It
has been reported by the learned APP, and even the office has also
stated in the remarks that the conviction appeal being Criminal
Appeal No.489 of 1999 is pending for final hearing before the
learned Single Judge (Coram: R.H. Shukla, J.) and the said appeal is
against the order of conviction.

The
present Criminal Appeal No.773 of 1999 is for enhancement of
sentence, whereas Criminal Appeal No.767 of 1999 is preferred
against the judgement and order of acquittal passed by the Court of
learned Additional Sessions Judge.

Considering
the facts and circumstances, it appears that with a view to maintain
the uniformity in the orders passed by this Court, it would be just
and proper if all the connected matters are heard by one Bench of
this Court, as may be directed by the Hon’ble the Chief Justice on
administrative side. Hence, office to place the papers before the
Hon’ble the Chief Justice on administrative side and list the matter
accordingly, as may be directed by the Hon’ble the Chief Justice on
administrative side.
